After the criminal charges are dismissed we advise our clients to expunge all Domestic Battery charges. The reason is to avoid any future problems with background checks or Firearm Owner’s Identification Card applications. The mere fact one is arrested can deprive them of employment opportunities. Expungement is a statutory process that erases the arrest from a criminal record. It’s relatively straight forward and results in this situation are guaranteed.

A client of mine who was a chief of police was falsely accused by his girlfriend of domestic battery. We tried the case and won. After acquittal he tried to become employed as a chief in other jurisdictions with no success. It was a mystery why he was not getting called back for interviews. Then we realized that although he was innocent of the charge the arrest still appeared on his background check. After we expunged the arrest he had no problem obtaining the job he sought and holds to this date.

Expungements are always available if the charge is dismissed and you have no other convictions. The expungement process typically takes 4 months to complete. Expungements erase the charge at the county and state levels.

We have obtained expungements for many clients. We normally do not require the client to appear in court as this is a legal procedure that does not require any facts other than have already been gained in the criminal charge file. This means no testimony is required. Usually we file 50 expungements in any given year. Most of my clients are college students or persons who know they will be seeking new employment in the near future.
